General Terms and Delivery Conditions

The following terms and delivery conditions apply to all commercial users of toonpool.com's services. They apply to all offers, deliveries and downloads on toonpool.com. By submitting an order, accepting deliveries or by downloading data from toonpool.com's server, you accept and agree to our general terms and conditions. After first-time effective agreement, they are valid for all future business relations between the client and toonpool.com.

§ 1 Rights of use

In general, all cartoons are available for one-time use only and attached to the conditions of use stipulated in the registration process. Exclusive rights might be negotiated with toonpool.com. Any redistribution of cartoons, in particular the transfer of usage rights to third parties, is strictly prohibited, unless otherwise stated in the registration conditions. Furthermore, it is prohibited to make alterations to the image , that would constitute copyright infringement. toonpool.com reserves the right to prohibit the use of its image materials at any time without giving reasons.

§ 2 Copyright mentions and specimen copies

In case of publication, the images should state the following copyright information: „artist/toonpool.com“. toonpool.com is allowed to demand a 100% surcharge if the publisher violates against this rule. We expect you to send two specimen copies for each publication to toonpool.com.

§ 3 Fees

Any use of toonpool.com's cartoons is subject to fees. Fee agreements apply to one-time use only, as specified in the registration conditions. Any further publication, for instance on the Internet, on TV, in affiliate papers and agencies, or on flyers, in brochures, with advertising materials and other data carriers must be remunerated separately. For the provision of hi-res image data, toonpool.com is entitled to charge additional download fees in the amount of 2.00 € per image data record. Low resolution downloads are free of charge. All fees and charges are plus statutory value added tax (VAT). Invoices are due and payable without any deduction upon receipt. Any additional payments, bank charges and shipping fees will be on buyer's account.

§ 4 Place of jurisdiction, liability

All contractual relationships, including delivery or transfer of usage rights abroad are subject to German law. Should individual regulations of this contract be or become legally ineffective and/or contradict to legal regulations, the contract as a whole will remain unaffected. The ineffective regulation will be replaced mutually with a operative regulation which corresponds as closely as possible to the economic purpose of the ineffective regulation and which is valid. Place of jurisdiction and place of fulfillment is Berlin.
